Terms and Conditions CHEF STAR RECRUITMENT OF STAFF – ENGAGEMENT OF CHEF CONTRACTORS 1. Relationship Recruitment – Hospitality Staff 1.1 Chef Star specialises in recruiting for the hospitality industry in both front of house and back of house operations at all levels. Our team of recruitment specialists have extensive knowledge and understanding of the hospitality industry and are committed to providing staffing solutions. Chef Contractors 1.2 Chef Star is engaged by a team of self employed Chef Contractors to act as marketing and booking agent. The Chef Contractors are at no times deemed to be employees of Chef Star. Chef Contractors booked through Chef Star are contracted to Clients on a temporary basis and as such are deemed contractors to the Client. Chef Contractors are responsible for their own insurances and on-cost and operated as their own business entity. 2. Employment of Contractors 2.1 Should any Chef Contractor be offered permanent, full time or on going employment with the client, permanent placement charges at the rates nominated by Chef Star from time to time shall apply in relation to such engagement, regardless of how the offer or acceptance of on going employment is negotiated. Permanent placement fees are available to the Client upon request. 3. Rate Structure and Payment 3.1 No variation in the quoted rates as per specific quotation or current rate schedule (current rate schedules are available upon request) will be valid unless confirmed in writing by Chef Star. 3.2 Consultancy and Chef Contractor invoices are payable within seven (7) days from date of issue. Failure to pay invoices within seven (7) days may result in refusal to honour future bookings. 3.3 Fees for the recruitment of permanent or full time of employees is based on percentages of the applicable annual gross salary package. Gross annual salary package will include any salary benefits ie. Company vehicle, accommodation and superannuation. 3.4 Placement fees as quoted are payable in Australian dollars and as follows: 25% payable prior to commencement of search. The remaining 75% payable within 7 days of placement. 3.5 Chef Star reserves the right to amend rates at any time on seven (7) days notice (unless price agreed to and guaranteed for a set period in writing) to the Client and all appointments of Chef Consultants following that date will be made in accordance with the new rates. 3.6 The engagement of an applicant introduced to you by Chef Star shall be deemed as your acceptance of the fees. 4. Minimum Shift Duration 4.1 Chef Contractors are guaranteed by Chef Star a minimum of three (3)
hours work per shift. Should the Client not require the Chef Contractor
for this period, a charge of three (3) hours will still apply. 5.1 All bookings for Chef Contractors are to be made through the offices of Chef Star only. Bookings should not be made directly with Chef Star staff of Chef Contractors. 6. Cancellations 6.1 Cancellation of bookings within four (4) hours (must be notified during business hours being 8.30am – 5.00pm Mon – Fri) of the booked start time may incur a cancellation fee of twenty-five dollars per Chef Contractor. 7. Workplace Health and Safety / Workers Compensation / Insurance 7.1 It is the responsibility of the Client to ensure a safe working environment for Chef Contractors. As Chef Contractors are under the direct supervision of the Client, and as such conditions exist, Clients agree to accept all responsibilities for compliance with work place health and safety requirements. Should any Chef Contractor be injured during their engagement with the Client, the Client shall immediately notify Chef star of the circumstances of such injury and thereafter the Client shall provide all cooperation and assistance to Chef Star or Work Cover QLD or any other insurer having interest in such incident. 7.2 The Client must have a valid Public Liability policy and be a registered work place. 8. Responsible Service of Alcohol 8.1 The laws regarding the service of alcohol are strict with harsh penalties applied for non compliance. Chef Star contractors will be fully supported by Chef Star should they feel it necessary to refuse service to patrons o the Client in order not to contravene Liquor Licensing Laws. 9. Vehicles / Machinery 9.1 Chef Star Chef Contractors are not permitted to drive client vehicles or operated machinery which the Chef Contractors are not qualified or suitably experienced to operate. Vehicles may be driven if permission is granted by Chef Star, however this will be at the Clients own risk. Neither Chef Star nor the employees of the agency accept liability for any damage to vehicle or other property unless common law has been contravened. 10. Disclaimer 10.1 The Client will be responsible for the inspection and being satisfied with work performed by any Chef Contractor and Chef Star will not be liable for any faulty workmanship or failure to work in a personable manner. The Client must report any issue with conduct of performance of Chef Contractors to Chef Star. 11. Warranty for Recruitment 11.1 All placements are covered by a three (3) month conditional guarantee, during which time replacements will be made with no further charge. Late payment of fees may result in the warranty being voided. 12. Withdrawn or Cancelled Recruitment Positions 12.1 Should a position be subsequently withdrawn or placed on hold after recruitment searches have been instigated, a minimum fee of $200 will be payable to cover administrative costs. Any additional costs for advertising specifically at the request of the client will also be chargeable. These advertising costs and fees unless otherwise specified, will be discounted from the full placement fee if the position is subsequently filled by Chef Star. 12.2 Should a placement be unsatisfactory within the warranty period, a replacement will be introduced without additional charge. 12.3 Should a replacement be required under a new job description, additional advertising and administration costs will be incurred. 12.4 Should a replacement not be required, fees will be refunded as follows:
Up to 30 days employed 75% of fee; Up to 60 days employed 50% of fee;
Up to 90 days employed 25% of fee; Over 90 days employed No refund will
be given. |
